How a Michigan payday loan works

You write the lender a check for the amount you want plus the fee. The lender gives you the money, in cash if you ask for it, and holds the check until the due date, usually your next payday and never more than 31 days away. Before lending, the lender must check the state’s database to confirm you do not already have a loan with it or two loans elsewhere. On the due date you repay in full, or the lender deposits your check.

Your written agreement must itemize the fee and show the equivalent APR, explain how to complain, explain how to cancel, and state that the loan is meant only for a short-term cash need.

What a payday loan costs in Michigan

The fee falls a little on each extra $100, but it is still a flat charge for a short loan. The Attorney General’s own figures:

Loan amountMaximum service fee
$100$15
$200$29
$300$42
$400$54
$500$65
$600$76

The lender may add a small database verification fee; DIFS reports it averaged $1.41 per loan in the year to September 2025. On a $600 loan, the $76 fee is about a 330% APR over 14 days and about 149% over 31 days by our own arithmetic. The average Michigan payday loan that year was $517.93 with a $66.61 fee.

The real cost is in repetition. Only 12.8% of Michigan payday borrowers took a single loan in that year; the average borrower took about ten. At the average fee, ten loans cost about $666 in fees.

If you cannot repay: the Michigan repayment plan

Michigan gives no right to extend a loan. What it does give repeat borrowers is an installment option: once you have taken eight or more payday loans in any 12-month period, the lender must offer to let you repay the eighth and each later loan that year in three equal installments, due on your next three paydays. You have to ask for it, orally or in writing at the lender’s place of business, within 30 days after the loan’s due date. The lender may charge a plan fee set by the statute and adjusted for inflation, and you cannot take another payday loan from any lender until the plan is paid. DIFS counted 104,982 repayment plans in the year to September 2025.

If your check is returned unpaid, the lender may charge one returned-check fee per loan, capped by the statute and adjusted for inflation. The lender can pursue the balance through civil collection but may not use any criminal process.

Your rights at the counter

  1. A licensed lender. Confirm the license with DIFS at 877-999-6442. An unlicensed online lender may follow none of these rules.
  2. A capped loan and a capped fee. No more than $600, no more than two loans at a time, and no more than the tiered fee above.
  3. Thirty-one days at most. No repayment date can be more than 31 days after the loan, and a lender cannot charge for any extension it gives.
  4. Next-day cancellation. Return the money by the close of business on the next business day and the loan is rescinded, fee refunded (MCL 487.2157).
  5. A remedy for violations. Tell the lender in writing, with supporting evidence; it has three business days to decide. If it agrees it broke the law, it returns your check, you return the cash, and it pays you five times the fee, at least $15 and no more than the face of the check. If it disagrees, file a written complaint with DIFS. You can also sue for actual damages, an amount equal to the fee, and reasonable attorney fees (MCL 487.2173).
  6. The federal Truth in Lending box. The APR, finance charge, amount financed, and total of payments must be disclosed before you sign.

What happens if you cannot repay

Ask about the repayment plan if you have taken eight or more loans this year, and ask before the due date. Otherwise, call the lender before the check is deposited. Read what happens if you default on a payday loan for how collection works, and how to escape the payday loan cycle if one loan keeps leading to the next. If the real problem is a bill you cannot cover, start with what to do when you can’t make this month’s payment. To complain about a lender, contact DIFS online or at P.O. Box 30220, Lansing, MI 48909.
