Payday loans are legal in Kentucky as deferred deposit transactions: a fee of up to $15 per $100, a term of up to 60 days, no more than two open loans, and no more than $600 in total proceeds under a 2026 law, checked against a statewide database. Rollovers for a fee are banned. Here is what the law allows, what a loan costs, your rights, and the lenders we review that serve Kentucky.
Payday loans in Kentucky are legal and licensed as deferred deposit transactions under KRS Chapter 286, Subtitle 9. The fee is capped at $15 per $100, a lender can hold your check for at most 60 days, you can have no more than two loans open at once, and the total you receive from all open loans cannot top $600. Rollovers for a fee are banned, and lenders check a statewide database before every loan. This page covers what the law allows, what a loan costs, your rights, and which of the lenders we review serve Kentucky. For how Kentucky compares with every other state, see payday loan laws by state.

How a Kentucky payday loan works
You sign a written or electronic agreement, dated and signed by you and the lender, and give the lender a check or payment authorization. The lender pays you the amount of the check minus its fee and agrees to hold the check for no more than 60 days. You get a copy of the agreement, and the fee must be disclosed in writing before you sign (KRS 286.9-100(1) and (13)).
Before lending, the lender must check the statewide database to confirm you have fewer than two open loans and that the new loan keeps your total proceeds at or under the limit (KRS 286.9-100(19) and 286.9-140). The limit was $500 until a 2026 law, Chapter 98 (Senate Bill 219), raised it to $600 for loans made on or after its effective date. The Act also has the Department of Financial Institutions adjust the limit by July 1 of each year for inflation, rounded up to the nearest $10, and never above $850.
What a payday loan costs in Kentucky
The fee is up to $15 per $100 of the check, for a period of at least 14 days:
| Check amount | Maximum fee | You receive | APR over 14 days |
|---|---|---|---|
| $100 | $15 | $85 | About 460% |
| $300 | $45 | $255 | About 460% |
| $600 | $90 | $510 | About 460% |
The APR column is our own arithmetic on the amount you receive, not a quote; your agreement states the actual finance charge. The lender may add the state’s $3 database fee to each transaction. Because rollovers for a fee are banned, the main way cost grows in Kentucky is taking a new loan to pay off the old one. The two-loan and $600 limits cap how far that can go.
Rollovers and new loans
A lender or its affiliate cannot renew, roll over, or consolidate a payday loan for a fee, and cannot use any device or agreement, including one with an affiliate, to get more than the law allows (KRS 286.9-100(11) and (14)). The limits that apply to new loans are the two open loans and the total proceeds cap, enforced through the database.
Your rights
- A licensed lender. Confirm the license with the Department of Financial Institutions at 502-573-3390 or kfi.ky.gov.
- A capped fee. No more than $15 per $100 of the check, disclosed in writing before you sign.
- A capped balance. No more than two open loans and $600 in total proceeds, across all lenders.
- No paid rollovers. The lender cannot charge you to renew, roll over, or consolidate a loan.
- No security or co-signer. The lender cannot require collateral or a guaranty from another person.
- No cold-check prosecution. You cannot be convicted under the cold-check statute for a payday loan, and the lender cannot prosecute or threaten to prosecute you under it. Every location must post a sign saying so.
- A copy of your agreement. You receive a copy of the signed agreement.
- The federal Truth in Lending box. The APR, finance charge, amount financed, and total of payments must be disclosed before you sign.
What happens if you cannot repay
Call the lender before the deposit date. The lender cannot charge you to roll the loan over, and it cannot threaten you with prosecution for a bounced check. If a lender threatens prosecution or charges more than the law allows, report it to the Department of Financial Institutions. Read what happens if you default on a payday loan for how collection works, and how to escape the payday loan cycle if one loan keeps leading to the next. If the real problem is a bill you cannot cover, start with what to do when you can’t make this month’s payment.
Alternatives worth trying first in Kentucky
Several routes usually cost less than a Kentucky payday loan, roughly cheapest first:
| Option | What it costs | The catch |
|---|---|---|
| Payment plan on the bill itself | Often nothing | You have to ask before the due date |
| 211 referral to rent, utility, or food help | Nothing | What is funded varies by area |
| Federal credit union PAL I | Up to 28% APR plus an application fee of up to $20; $200 to $1,000, 1–6 months | One month of membership first; one PAL at a time |
| Federal credit union PAL II | The same caps; up to $2,000, 1–12 months | Not every federal credit union offers one |
| Kentucky payday loan | Up to $15 per $100: $90 on a $600 check, so you receive $510 (above) | About 460% APR over 14 days; two open loans at most |
The credit union limits come from federal regulation (12 CFR 701.21(c)(7)): no more than three PALs in six months, and no rollovers. Call 211 to reach the local referral line. Employer pay advances and earned-wage apps cost more than their small fees suggest; payday loan alternatives that actually work has the numbers for each option. If an installment loan is on the table, installment loans vs. payday loans explains how to compare total cost.
If you do borrow, borrow the smallest amount, take the latest deposit date the lender will agree to, and confirm the lender’s Kentucky license before you sign.

Frequently Asked Questions
Are payday loans legal in Kentucky?
Yes. Kentucky calls them deferred deposit transactions and regulates them under the Kentucky Financial Services Code, KRS Chapter 286, Subtitle 9. Lenders are licensed and supervised by the Department of Financial Institutions.
How much can I borrow with a payday loan in Kentucky?
You can have no more than two open payday loans at a time, and the total proceeds from all open loans cannot exceed $600 (KRS 286.9-100(9)). A 2026 law, Chapter 98 (Senate Bill 219), raised the limit from $500 and has the Department of Financial Institutions adjust it each year for inflation, up to a ceiling of $850. Lenders check a statewide database before every loan.
How much does a payday loan cost in Kentucky?
The service fee cannot exceed $15 per $100 of the check, for a period of at least 14 days (KRS 286.9-100(1)). That is $90 on a $600 check, so you receive $510. On a 14-day loan, that fee works out to about 460% APR on the money you receive. The lender may also pass on the state's $3 database fee per transaction (KRS 286.9-140(2)).
Can I roll over a payday loan in Kentucky?
No. A lender or its affiliate cannot, for a fee, renew, roll over, or otherwise consolidate a payday loan (KRS 286.9-100(14)), and cannot hold your check for more than 60 days (KRS 286.9-100(12)).
Can I be arrested for not paying a payday loan in Kentucky?
No. Kentucky law says a person who enters into a deferred deposit transaction cannot be convicted under the cold-check statute, KRS 514.040, and the lender cannot prosecute or threaten to prosecute you under it (KRS 286.9-100(15) and (16)). Every payday lender must post a sign saying so.
Are online payday loans legal in Kentucky?
From a Kentucky licensee, yes. A Kentucky resident can sign a payday loan agreement by telephone or other electronic means (KRS 286.9-100(13)). The same fee, amount, and database rules apply.
What can I use instead of a payday loan in Kentucky?
Start with a payment plan on the bill itself, or call 211 for local rent, utility, and food help. For a loan, a federal credit union Payday Alternative Loan is capped at 28% APR plus an application fee of up to $20: a PAL I is $200 to $1,000 over one to six months after a month of membership, and a PAL II is up to $2,000 over one to twelve months. For comparison, a payday loan in Kentucky costs up to $15 per $100, which is $90 on a $600 check, so you receive $510.
Who regulates payday lenders in Kentucky?
The Kentucky Department of Financial Institutions, 500 Mero Street, Frankfort, KY 40601, at 502-573-3390. Its website is kfi.ky.gov, where you can file a complaint.
